Inherent Risks of Diving

By participating in diving activities, you acknowledge that risks include, without limitation:

• Drowning or near-drowning
• Decompression sickness, arterial gas embolism, and other pressure-related injuries
• Equipment failure or malfunction
• Marine life hazards
• Loss of buddy contact or team separation
• Adverse or changing environmental conditions
• Human error, including your own and that of other divers
• Medical events occurring during a dive

This list is illustrative, not exhaustive. No planning tool, including Dive Backup, can identify, eliminate, or reduce all risks inherent to diving.

Dive Backup Does Not Reduce These Risks

Use of Dive Backup — including creating a dive plan, reviewing and acknowledging a plan, using Planning Lab calculation worksheets, or accessing Emergency Mode — does not reduce, eliminate, or transfer any of the inherent risks of diving described above. Organizing information about a dive is not the same as making that dive safer, and no feature of Dive Backup should be understood or relied upon as doing so.

Acknowledgment of a dive plan within Dive Backup confirms only that a participant indicated they reviewed a specific version of that plan. It is not a waiver, release, or transfer of responsibility, and does not replace any liability waiver, release of liability, or assumption-of-risk document you may separately execute with a dive operator, charter, instructor, or training agency.

Relationship to In-Person Waivers

This page is not the in-person liability waiver that most dive shops, charters, and instructors already require divers to sign before a dive — it does not replace that existing waiver, and a third-party waiver you sign with a dive operator, charter, instructor, or training agency remains in effect on its own terms.

Voluntary Participation

You participate in diving activities voluntarily and assume full responsibility for your own safety and decision-making, and — where applicable — for the safety and decision-making of participants under your supervision as an instructor or dive leader, independent of any information organized or calculated by Dive Backup.

Acknowledgment

By using Dive Backup in connection with any diving activity, you acknowledge that you have read and understood this Assumption of Risk. This page is governed by, and should be read together with, the limitation-of-liability language in the Terms of Service and Disclaimer.
